Privacy Policy Statement
Cuisine Continental Group (HK) Limited and Cuisine Continental (HK) Limited (“the Company”) are committed to safeguarding the privacy of individuals with respect to personal data. We ensure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong (the "Ordinance"). This circular sets out the obligations and policies of the Company on how we, under the Ordinance, will manage information we collect from you through our websites and online services, including www.cuisinecontinental.com.hk, www.delifrance.com.hk and www.alfafa.com.hk, Cuisine Rewards application and any other owned or operated websites, social media platforms and online services that link to this Privacy Policy (collectively the “Sites”) and through our restaurants/outlets/self-order facilities, calls or other channels (“Services”). By continuing to use the Sites and/or Services and/or submit application/request to us and/or submit Data to us via any means as mentioned above after the Privacy Policy is changed or amended, you are deemed to have consented to such changes or amendments.
Type of Personal Data Collected
When you subscribe to be a member of the Company or use our services, including managing your membership, or accessing related products and services, you may be requested to provide personal data such as your full name, date and year of birth, age, gender, email address, telephone number, corresponding and/or billing address, account details, contact details, information for the verification of identity, profession, account status and account-related activities.
We also collect some of your personal data whenever we communicate with you, or when you complete any voluntary surveys and questionnaires we may send you from time to time, to further improve the Company’s products and services presented to you. Failure to provide such requested data or information may sometimes defer or prevent us from providing the products or services to you.
When you visit our Site or App, we may use online tracking technology such as cookies, pixel tags, web beacons and other similar technologies to automatically collect information about: your visits to our Site or App, such as your browsing history, how long you stay on our Site or App, and how often you visit; your location information as provided by your mobile or other device when you interact with our Site or App, including your IP address and general geographic location; and the device that you use to browse our Site or App (e.g. your device ID, operating system, type of device, browser type and version, mobile application crashes and other system activity, and third party sites you were using before interacting with our services). You have the right to disable any of these online tracking technologies.
Under certain circumstances, telephone calls made to and from the Company’s services hotlines and/or inquiry telephone numbers will be recorded for the purposes of quality control, appraisal, as well as staff management and development. At all times, care is taken to protect such recordings from unauthorised access.
Use of Personal Data
Your personal data may be used for:
- verifying your identity and provision of goods and services to you;
- marketing and advertising of any goods and/or services to you by the Company, agents, contractors and third party upon your consent in accordance with the requirement of the Ordinance;
- business planning and improving goods and/or services to you by the Company;
- processing of any benefits or membership application in connection with the supply of goods and services to you;
- checking of your credit, payment and/or status in relation to the supply of goods and services to you;
- processing of any payment instructions or credit facilities in relation to supply of goods and services to you;
- enabling the daily operation of your membership account and/or collection of amounts outstanding in your account with the Company;
- prevention of crime;
- disclosure as required by law;
- handling of complaints and enquiries of the customers; and
- any other purposes as may be agreed between you and the Company, in addition to those outlined in this Policy.
Accuracy of Personal Data
The Company may need to validate your personal data to ensure accuracy or authenticity of the identity document provided by you. We may request you to produce the identity document in person for checking at a time convenient to you.
The Company shall take reasonable steps to keep your personal data as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used. You can update or correct the Data held by us by contacting our Customer Services team.
Retention of Personal Data
The Company will destroy any personal data it may hold in accordance with its internal policy.
(i) Personal data will only be retained for as long as is necessary to fulfil the original or directly related purposes for which it was collected, unless the personal data are also retained to satisfy any applicable statutory or contractual obligations; and
(ii) Personal data are purged from the Company’s electronic and other filing systems in accordance with the schedules based on the company’s internal procedures.
Security of Personal Data
We will use reasonable security technologies and procedures to protect the personal from unauthorized access, use or disclosure. However, due to the nature of the Internet and technology, it is possible that others may intercept the information you are sending to or transmitting through the Sites. We do not warrant that the Sites are impenetrable or invulnerable to hackers.
Disclosure of Personal Data
All personal data held by the Company will be kept confidential and will not be disclosed or transferred to any other party, except when necessary to satisfy the purpose or a directly related purpose for which the data was collected. In such cases, the Company may provide such personal information to the following parties:
(i) any subsidiaries, associated companies, or affiliates of, or companies controlled by, or under common control with or within the Company upon your consent in accordance with the requirement of the Ordinance;
(ii) any person who is acting for or on behalf of the Company or jointly with the Company, in respect of the purpose or a directly related purpose for which the data was collected, for administrative and other purposes deemed necessary to maintain service and improve service ;
(iii) Any other person or company who is under a duty of confidentiality to the Company and has undertaken to keep such information confidential, provided such person or company has a legitimate right to such information; or
(iv) Government and regulatory authorities and law enforcement agencies and other organisations as required or authorized by law.
Transfer of Personal Data Outside Hong Kong
It may be necessary for the Company to transfer certain personal data to places outside the HKSAR in order to carry out the purposes or directly related purposes for which the personal data were collected. Where such a transfer is performed, your consent in accordance with the requirement of the Ordinance will be obtained.
Access and Correction of Personal Data
(i) You have the right to request access to and correction of personal data in its possession which is inaccurate for the purpose for which it is being used by means of a data access request ("right of correction"). You have further right to ascertain whether the Company holds any personal data relating to you and, if so, to obtain copies of such data (“right of access”).
(ii) You may exercise your right of access by completing the “Data Access Request Form” as prescribed under the Ordinance and sending the completed form to us. Our staff will make a call to you after receiving the completed form and respond to your request upon authenticity and verification is satisfied.
Direct Marketing
We may use your personal data including your name, phone number, email, address and/or your response to any online survey or other activities to contact you about products, services, promotions and events of or relating to the Company and our affiliated restaurants and food outlets, including those products, services, promotions and events jointly provided, organised or co-branded with third parties;
The Company will honour your request not to use your personal data for the purpose of direct marketing unless your consent is obtained. You may at any time send a request to our Customer Services team with your registered name and contact telephone number to stop receiving the promotion materials or to start receiving the same. We shall cease to use your personal data for direct marketing purpose within 1 month from the date of receipt of your complete request.
This privacy policy is written in English and has a Chinese translation. In case of discrepancies or conflicts between the two versions, the English version shall prevail.
This policy is subject to review and amendments as necessary.
